These terms govern your use of the LandlordFile website at landlordfile.co.uk and the LandlordFile service. By using either, you agree to these terms. If you do not agree, please do not use the service.
1. Who these apply to
These terms apply between you (the user of the website or service) and Gary Scott, a sole trader trading as LandlordFile, based in Eaton Socon, Cambridgeshire, United Kingdom (“we”, “us”, or “LandlordFile”).
2. What LandlordFile is
LandlordFile is software that assists UK landlords in preparing and submitting quarterly Making Tax Digital (MTD) Income Tax Self Assessment (ITSA) returns to HM Revenue & Customs (HMRC).
LandlordFile is not accounting advice, not tax advice, and not a substitute for professional accountancy. You remain responsible for the accuracy of the data you submit and for meeting your own tax obligations. If your circumstances are complex, you should consult a qualified accountant or tax adviser.
3. Your responsibilities
- Provide accurate and complete information, including rental income and expense figures.
- Keep your HMRC credentials secure and revoke access if you believe they have been compromised.
- Keep independent copies of your records — LandlordFile is a convenience, not your system of record.
- Comply with your own tax obligations, including submitting returns on time and paying any tax due.
- Use the service only for lawful purposes.
4. Payment and cancellation
LandlordFile is offered on a subscription basis. Pricing will be confirmed at launch; indicative pricing is shown on the landing page. You may cancel at any time; your access continues until the end of the current billing period and no refund is due for unused time unless required by law.
5. Limitation of liability
- LandlordFile is not liable for HMRC penalties, interest or other adverse outcomes that arise from inaccurate, incomplete or late data supplied by you.
- To the maximum extent permitted by law, LandlordFile is not liable for indirect, consequential or special losses, loss of profit, loss of business, loss of anticipated savings, or loss of data.
- Our total aggregate liability in connection with the service in any 12-month period is limited to the fees you have paid to LandlordFile in that period.
- Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by English law.
6. Termination
Either party may terminate on reasonable notice. We may suspend or terminate your access immediately if you breach these terms or misuse the service. On termination we will, on request, provide a reasonable export of your data before deletion, subject to the retention periods set out in our privacy policy.
7. Changes to these terms
We may update these terms from time to time. If the changes are material, we will notify registered users by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
8. Governing law and jurisdiction
These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these terms or the service.
